College Collective Terms of Use

These College Collective Terms of Use ("Terms of Use") apply to the website that posts a link to these Terms of Use (each, a "Service" or "College Collective Website"). Cluster Technologies, Inc. is referred to collectively in these Terms of Use as "Cluster," “College Collective," "College Collective Website," "we" or "our." "You," "your" and "user" refer to any person or entity using the Service.

These Terms of Use govern your use of the Service, regardless of how you access them, whether by computer, mobile device, or otherwise; and whether directly through our Service, or through any third-party website that links to them ("Linked Services"), and regardless of whether you are a registered user or a visitor. By using the Service, you agree to the Terms of Use. If you do not agree to the Terms of Use, you are not authorized to use the Service and you must cease all such use immediately.

To the extent there is a conflict between these Terms of Use and any Additional Terms, the Additional Terms will control unless the Additional Terms expressly state otherwise.

Account Registration & TerminationCollege Collective is an online service designed to provide a list of fully-online programs from community colleges and education institutions within the United States. You may only have one College Collective account for use of the Service. You may not create or use more than one account, and you may not share your account or any of the Service with others. All information you provide to create an account must be accurate and complete. You may not impersonate any other person or use a name that is not your own. It is your responsibility to update your account information to keep it current and accurate. When you set up an account, you must also choose a password. You are solely responsible for maintaining the confidentiality of your password, and for any and all use of your account. You agree to notify College Collective immediately if you suspect any unauthorized use of your account or access to your password. College Collective has the right to terminate your account for any reason at our sole discretion without notice to you.

Age and Residence Requirements; U.S. JurisdictionThe Service is available to individuals age 13 and over. If you are between the ages of 13 and the age of majority where you live, you must review these Terms of Use with your parent or guardian to confirm that you and your parent or guardian understand and agree to it. You may register for an account regardless of where you live. We reserve the right to limit the availability of the Service and/or the provision of any content, program, product, service or other feature to any person, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities of any such content, program, product, service or other feature that we provide.

Proprietary RightsThe Service is owned and operated by Cluster Technologies, Inc. Unless otherwise explicitly specified by College Collective, all information that is included as part of the Service, including past, present, and future versions, domain names, source and object code, the text, site design, logos, graphics, as well as the selection, assembly and arrangement thereof and the "look and feel" of the Service (collectively, "College Collective Content"), are owned, controlled, or licensed by College Collective. College Collective Content is protected from unauthorized use, copying and dissemination by copyright, trademark, patent, and other laws, rules, regulations and treaties.

Acceptable Use PolicyYou are authorized to use the Service to browse and search for fully-online programs from community colleges listed on the Service, and to create an account to save programs to your account.

Prohibited activities include, without limitation:Modifying, copying, distributing, downloading, scraping or transmitting in any form or by any means, in whole or in part, any content from the Service; any automated use of the Services, such as, but not limited to, using scripts to create accounts or to browse site content; interfering with, disrupting, or creating an undue burden on the Service or the networks or services connected to the Service; or using the Service in a manner inconsistent with any applicable law.

Service ModificationsCollege Collective reserves the right, in our sole discretion, to make changes to or discontinue any of the Service at any time. Any description of the Service provided by College Collective is not a representation that the Service is working or will always work in that manner, as College Collective is continuously updating the Service, and these updates may not always be reflected in the Terms of Use.

Email NotificationsNotifications from College Collective will be delivered to you by email at the address you provided to College Collective when you created your account or as later updated. College Collective will not ask you for your personal information, account username, and password, or any information about you or your method of payment via email or text message. If you receive such an email or text message purportedly from College Collective, it is fraudulent and College Collective will have no responsibility for any misuse of any information you provide as a result.

Account CancellationYou may request cancellation of your account at any time throughout your use of our Service. To the fullest extent permissible under applicable law, your account will only be cancelled and closed after you have contacted us and requested to close your account via our contact form: College Collective may cancel your account at its sole discretion for any reason, including but not limited to inactivity or misuse.

Third-Party Links, Content and ApplicationsYou may request cancellation of your account at any time throughout your use of our Service. Functionality on the Service may also permit interactions between the Service and a third-party web site or online feature, including applications that connect the Service or your profile on the Service with a third-party site. For example, the Service may include a button enabling you apply to a program directly, or enable you to ask a school to contact you directly. We do not control any of these third-party sites or any of their content. Neither College Collective nor its service providers are responsible for the practices of any third-party. Accordingly, you expressly acknowledge and agree that we make no representations or warranties about the completeness, accuracy, or existence of any advertising, products, or other materials on or available from third-party sites or online features and any reliance placed by you on such materials is at your own risk.

Linking PolicyCollege Collective grants you the revocable permission to link to the website on which these Terms of Use are posted; provided, however, that any link to such a website: (a) must not frame or create a browser or border environment around any of the content on such web sites or otherwise mirror any part of such websites; (b) must not imply that College Collective or the Service are endorsing or sponsoring any third-party or its products or services, unless College Collective has given the third-party prior written consent; (c) must not present false information about, or disparage, tarnish, or otherwise, in College Collective’s sole opinion, harm College Collective or its product or service; (d) must not use any College Collective trademarks without the prior written permission from College Collective; (e) must not contain content that could be construed as distasteful, offensive or controversial or otherwise objectionable (in College Collective’s sole opinion); and (f) must be owned and controlled by you or the person or entity placing the link, or otherwise permit you to enable such link subject to these Terms of Use. By linking to the College Collective Website, you agree that you do and will continue to comply with the above linking requirements.

Notwithstanding anything to the contrary contained in these Terms of Use, College Collective reserves the right to prohibit linking to the College Collective Website for any reason in our sole and absolute discretion.

Categories of UsersYou may use College Collective’s Service as a “User” or as a "Visitor." "Users" include those who have registered for an account. "Visitors" are users that have not registered for an account with access to and use of certain aspects of the Service, which may be restricted and only available to Users.

Career Information and JobsCollege Collective's site may help students identify potential careers by providing a basic description for a variety of potential jobs associated with a Program’s Field of Study. College Collective is simply one starting point, not an exhaustive list of all potential jobs or opportunities that might be available to you, and in a fast-changing employment landscape College Collective does not guarantee that the descriptions, salaries and job opportunities set out on our site are always up to date, reflect the current job market, or are applicable to the market in your area. We believe that the content on our site can help you find a fully-online program at a community college that suits your interests. Still, College Collective does not provide in-depth, individualized job counseling, and your success in landing a job in a particular career depends on a wide variety of factors. Completing a program is not a guarantee of finding employment in that field, or any other field.

Disclaimer of Warranties; Limitations of Liabilities

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk, The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall College Collective, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenues, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract or tort (including negligence), strict liability or otherwise, arising from your use of the Service, or for any other claim related in any way to your use of the Service, including but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Reporting Copyright and Other Intellectual Property ViolationsCollege Collective respects the intellectual property rights of others and takes the protection of copyrights and other intellectual property seriously. Only the intellectual property rights owner or person authorized to act on behalf of the owner can report potentially infringing content. College Collective will provide you with notice if your materials have been removed based on a third-party complaint of alleged infringement of the third-party's intellectual property rights.
